Terms of Service

These terms govern your use of NearbyPick, a product of HAMR1 LLC, an Alabama limited liability company doing business as NearbyPick (“NearbyPick,” “we,” or “us”). The service

NearbyPick measures how selected AI assistants describe a local business for a defined set of questions on ChatGPT, Gemini, Perplexity, and Claude. Google AI Overviews support is planned. Scores and recommendations reflect the answers those assistants returned at the time of each scan. AI answers change over time. A mention, ranking, or lead volume is never guaranteed.

Accounts

You must provide accurate account information and keep your sign-in email under your control. You are responsible for activity on your account. Contact support@nearbypick.com right away if you think someone else used it.

Trial and payment

The free scan does not require a card. A new account gets 14 days with no card. On day 14, if you have not paid, the account pauses. Data from a paused trial is kept for 30 days and then deleted, and any Stripe subscription on that account is canceled. To continue, pay through Stripe Checkout. Checkout charges the price shown. It does not start a second hidden trial.

The tier price applies to every location. Annual billing is 10 times the monthly unit price. Quantity in Stripe is the location count. You cancel in the Stripe customer portal. Cancellation takes effect at the end of the current period. After a paid cancel, data is kept for 90 days, then deleted.

Stripe Smart Retries run for up to 2 weeks. If the last retry fails, the subscription is marked unpaid and the account pauses. We do not hard-cancel it then. When you add a card, the old failed invoice is voided and a new billing period starts.

Refunds

Full refunds are available within 7 days of the first payment only. Email support@nearbypick.com to request one. After that window, charges are non-refundable except where required by law. Canceling through the Stripe portal stops future charges at period end; it does not refund the current period unless a first-payment refund applies.

Fixes and recommendations

The first run proposes fixes and waits for your approval. After that, new items are approved automatically and a weekly summary is sent, unless you set the account to approve each change. This version does not edit Google, Bing, Apple, or Facebook listings for you.

Acceptable use

You may use NearbyPick only for lawful business purposes and only for locations you are authorized to manage. Do not attempt to disrupt the service, probe other customers' data, or misuse AI scan capacity.

Intellectual property

NearbyPick, its software, and its branding belong to HAMR1 LLC. You keep ownership of the business information you submit. You grant us a limited license to process that information to provide the service.

Disclaimer

The service is provided “as is.” We do not warrant that AI assistants will name your business, that scores will improve, or that the service will be uninterrupted or error-free. AI output is informational only and is not legal, financial, or marketing advice.

Limitation of liability

To the fullest extent allowed by law, HAMR1 LLC and its members, officers, and contractors are not liable for indirect, incidental, special, consequential, or lost-profit damages, or for loss of data or business opportunity, arising from your use of NearbyPick. Our total liability for any claim related to the service is limited to the fees you paid us for NearbyPick in the three months before the claim.

Indemnity

You agree to defend and hold harmless HAMR1 LLC from claims arising out of your misuse of the service or your violation of these terms, except to the extent caused by our willful misconduct.

Governing law

These terms are governed by the laws of the State of Alabama, without regard to conflict-of-law rules. Courts in Alabama have exclusive jurisdiction, except where applicable law requires otherwise.

Changes

We may update these terms. The “Last updated” date at the top will change when we do. Continued use after an update means you accept the revised terms.
